Typlex pipe repairs: Finding the right support

The Iplex pipes class action covers all homeowners who acquired Iplex "Pro-fit" pipes manufactured between 2017 and 2022 using Typlex 1050 resin, regardless of where they live or the builder involved.

It is estimated that around 30,000 homes were built or renovated in Australia with the affected pipes, with about half of those in Western Australia.

The class action is seeking compensation not just for those already impacted by leaks but also for other losses on the basis that the pipes do not meet acceptable standards under the Australian Consumer Law, for example the costs of removing and replacing the affected pipes.

Filed in the Federal Court of Australia in August 2024 by legal firm Baker McKenzie, the class action also alleges that Iplex engaged in misleading and deceptive conduct.

If you are one of the homeowners affected, you are automatically a group member in the class action. However, it is also important to register, so that you can be kept up-to-date as the legal proceedings unfold.

The Joint Industry Response

The joint industry response (JIR) is an agreement between the Western Australian Government and pipe manufacturer Iplex which came into effect in late 2024. But not everyone is covered.

Under the agreement, participating builders can access funds to undertake some repairs of homes affected by leaking pipes. However, not all eligible builders have registered to participate in the JIR.

The agreement is limited to Western Australia and even then, many homeowners fall through the cracks as the pipes will only be completely replaced if an eligible homeowner has had three or more leaks – any less than that, and the repairs are more limited.

Why you should register for the Iplex pipes class action

Many homeowners are uncertain about whether being part of a class action could affect their ability to get assistance through the JIR.

The concern is that a legal outcome through the class action, even if successful, could be some way off, while the JIR is already available to many affected Western Australians.

Here are some things to know:

    • Being a member of the class action does not affect your ability to get assistance through the JIR if you are eligible.
    • Whether you have received benefits through the JIR or not, you can still register your interest for the Iplex pipes class action.
    • Repair costs already covered under the JIR cannot be recovered again in the class action.

Although you will not be required to pay anything out-of-pocket to participate in the class action, if the class action is successful in court or settles out of court, your share of legal fees may be deducted from any compensation you receive.

A litigation funder is paying the legal fees in the class action. The funder in this case is Fortress Investment Group. In return for funding the case and taking the risk of paying Iplex’s legal costs if the case is successful, Fortress will seek to be paid a percentage of the total settlement or compensation award as a funding commission.
